The Client wishes to terminate the Contractors obligation to Provide the works. The Project Manager is making an assessment of the final amount due (this should be done no later than 13 weeks after accoring to clause 53.1). My question is, how can the Parties work together during these 13 weeks?
If it is the Client’s declared wish to terminate then you should be using the early warning mechanisms to discuss the issues and the way forward to terminate in a controlled way.
This may well result in some additional instructions - and hence compensation events - to secure the Site, make sure it won’t deteriorate etc. rather than the Contractor just dropping tools and walking away on termination.
Post-termination, the mean point of co-operation is to ensure the final account is wrapped up in accordance with the contract provisions.
