NEC 3 - ECC - Direct / Subcontract Fee

We are a Contractor on a NEC3 ECC Option E Contract.

We have multiple subcontract agreements and purchase orders in place with a single organisation.

Can the organisation be considered as both a Subcontractor and a supplier ?

Kevin, in short yes.
Refer to the definition of a Subcontractor under clause 11.2(17), for each contract which falls under the definition they will be a Subcontractor, for those that do not, they will be a supplier (not a defined term).
