Within the contract layout and file structure, documents are filed within folders. If there is a specific folder in the contract titled “works information” should other document folders be disregarded when it comes to 60.1 (1)? If other folders contain design and survey information, but are not within the folder titled “works information” does this matter?
Clause 11.2(19) NEC3 / 11.2(16) NEC4 defines that the Scope/Works Information is “in the documents which the contract Data states it is in” or in an instruction ……….
The Contract Data will therefore tell you what documents are the Works Information.
If the Contract Data states the folder to be Works Information and there are no other folder references then the other folders are not works Information unless expressly referred to in the Works Information
