What is the purpose of the end of liability date?

The Contractor’s liability to the Employer may not end when the Defects Certificate has been issued, particularly if a Defect becomes apparent some time after the defects date (known as latent defects). Many, but not all, jurisdictions have cut-off periods after which the Contractor is not liable for latent defects. The end of liability date under Clause X18.5 can be used either to introduce such a cut-off period if none exists, or shorten the existing one.
