To avoid issues with non-defect based shrinkages not being covered, could it be included in the ERs that all issues with shrinkages are put right regardless of whether it is due to a defect (essentially making it a defect but allowing rectification period to commence)?

If the employer wishes a Clerk of Works or technical advisor to be appointed to check quality, but given there are no express provisions within the contract for their appointment, does the Employer’s Agent need to physically be present during such inspections to instruct opening up for inspection etc.? @stevencevans

No need for the EA to be present. Clause 3.1 provides that ‘any person authorised’ by the Employer’s Agent can have access to the Works and workshops and other premesis at all reasonable times
