Scope information ambiguity and Contractors Design

NEC4 Option B – Original scope included a contractor design element for the design of beam and block flooring, a contractor proposal was subsequently accepted to amend this to a precast plank construction. Contractor has employed a subcontractor to design and supply the precast floor planks. During installation it has been established that there was an anomaly on one of the original scope drawings which showed an erroneous wall, the precast plank design was developed on the basis that this wall would be built but it never was which has resulted in the need for additional steel supports to be installed to support the precast planks at first floor level. Where does the liability fall here? If the contractor is responsible for the design of this flooring and has been selective of the information passed onto their subcontractor do they undertake some of the liability? The contractor has built the structure at ground floor without building the erroneous wall so was aware that this wall was not required as it is not shown on any other drawings.

If the wall is shown in the Scope and not been constructed then there should be an omission and the extra steel should be added in as a compensation event.
