If a Contractor is carrying out Design activities for a Client under an NEC Option E Contract, is the Contractor able to raise a CE if the Client requests the development of the Design is temporarily paused due to delays to their programme / funding issues?
Yes. The Client has instructed the Contractor to stop and this is a Compensation Event, see 60.1 (4) (un-amended)
