NEC TSC Contract - Option A

Currently working on an NEC3 TSC contract - Option A. The Contractor has provided a Price List which contains both Lump Sum Prices and Prices arrived at by multiplying hourly labour rates by a quantity.

The Contractor has exceeded the number of hours he has included in his Price List for a number of items and is therefore claiming additional monies against these items. Is he entitled to these additional costs even though they increase the overall Total of the Prices?

The short answer is no.

In Option A, the Activity Schedule is just a mechanism to facilitate payment - you complete the activity and then get paid.

How that sum is calculated is their risk - unless they have an implemented CE, the prices cannot be changed

This is a TSC contract, so it’s a Price List as opposed to an Activity Schedule. From my reading the rules are different.
