JCT D&B 2016 Prolongation Prelims

The Contractor on site has a 10 week programme is ahead by 2 weeks, despite also completing a number of variations which have caused a 2 week delay to the critical path.

Is the Contractor entitled to 8, 10, or 12 weeks prelims?

They are arguing they are entitled to 12 as they should get the benefit of being ahead by out performing their productions and working over time.

Its a D & B contract therefor they’re entitled to the contract sum i.e. 10 week.

then you ask the question, within the variation’s, did the contractor include additional prelims, or acceleration costs?

then there is the question on an extension of time? if the Contractor has requested and included prelims, that will be your answer.
