If a payment is conditional on the completion of a Supervisor’s test and the test has not been carried out, when is the payment due?

Providing the Contractor is not to blame for the Supervisor failing to carry out the test, the payment becomes due either at the defects date or at the end of the last defect correction period (whichever is later) (see Clause 40.5).
