A contractor seeking payment for works done is told that there are defects in his works. He attends site to inspect the defects in his works and is the subject of a criminal assault by the owner who hold a knife to his throat saying “if you pursue this claim I will hurt you” (or words to that effect). Does the action by the owner constitute a repudiatory breach of the contract between the parties?
