When an architect is charged extra fess for work which results from a contractor breaching certain obligations, can the employer recover these fees from the contractor?

This is dependent upon contractual circumstances. A contractor is entitled to submit an application for losses as stipulated in a contract, but should not exceed what is stated within the contract. Should a contractor make a claim that is demonstrably wrong, (s)he may face criminal interrogation regarding obtaining money by deception.
