Working on an Option A NEC3 contract, working days Mon-Fri. To meet our completion date, we and our contractor are proposing they throw more resource at the job and also undertake works on the weekend (Saturdays). No acceleration or change of dates, just countering a delay, the Activity Schedule is the same as well.
We have the CE but there is a sticking point at the moment on the People rates for the Saturday work.
The Contractor is proposing their shifts at the standard rate plus an extra over percentage for Saturday working (this is an agreed percentage in the framework for weekends/OOH).
Our counter is the Contractor is already getting the standard rate in the contract for the agreed activities, and they are only entitled to the extra over cost for doing those activities on a Saturday, this is the additional cost.
For example, using made up numbers:
Standard rate = £50 p/hr
Standard rate + e/o = £65 p/hr
Diff = £15 p/hr
Are they entitled to the full £65 p/hr or just the additional cost which is £15 p/hr?
