Can Installation be done under a Supply Contract

There is a contract requirement in circa of £600k, which is predominantly Design and Procurement, however there is a small element of installation and commissioning to be undertaken. Supply Contract Guidance states that “Users should note the SC is not intended to cover installation or work done by Supplier”. Clarity is required in respect to why it is not intended and whether or not this is to the exception.

Quite a few years ago I was asked to do a review of the Supply Short Contract for a little bit of work done on Site and came to the conclusion that the principal difference needed was to have insurance provisions for working on Site. As a result, we ‘stole’ the relevant clauses from the ECC and inserted into the contract. To my knowledge, it worked.
