Wrong contract type sent with Tender Document

I have a situation where the team has issued a Tender to the market for Transformer Insulation Oil with Term Service Contract (NEC3 TSC). I believe this was a mistake as this should be a Supply Contract (NEC3 SC). The team is currently evaluating the Bids. Is the a way that we can conclude the contract or should we cancel the Tender?

What are the implications/challenges of admistering an NEC3 TSC for NEC3 SC scope of work?


The way in which the tender would be priced under an NEC Supply Contract and NEC Term Service Contract is fundamentally different so you would need to ask the bidders to retender.

The terms and conditions are difference between the two contract types so you could not administer a TSC as though it was a SC.
