Terminating employment under the contract is a contractual procedure where only one part of the obligation is ended (the contractor’s obligation to do the work) and the payment procedure will be replaced with a different procedure depending on who’s at fault. The contract remains in force.

Termination of the contract is at common law where a repudiatory breach by one party is accepted by the other bringing the entire contract to an end (save for some accrued rights)

In the context of JCT contracts it is just terminology presumably to differentiate a determination under the contract from a termination at common law.
