Under an NEC4 Option A contract a compensation event quotation has been issued to the Client. It included an element of prelims for both the contractor and a quotation from their subcontractor with prelims also included.

The Client has made an assessment and the additional works are not deemed to be on the critical path of the accepted programme and the prelims have been taken out of both the contractor costs and their subcontractor costs.

Is this correct and the client is able to take prelim costs out of the contractors subcontractor quotation?

@trauts80 if the extra prelims are claimed as a result of delay to planned Completion due to the CE and it turns out that there is no such delay (by the additional works not being on the critical path), then it sounds correct.
