We are sub-contractor working under NEC 4 option B (with BOQ).
An issue has arisen during drainage works were a civils drawing (issued at tender stage) shows all storm trenches lined with a membrane. However in the BOQ the description for the storm lines does not make reference to this membrane. The membrane had been ‘missed’ by ourselves when pricing and therefore not accounted for when submitting our tender for the works. We have since been approached by the clients QS for a ‘saving’ on the membrane as it has since been deemed not necessary and removed from the scope of works. Our question is that since it there is a discrepancy between the BOQ and the tender drawings can this be considered a ‘saving’?
You may wish to review B60.7. If you have not already notified an inconsistency it might be wise to do so.
My conclusion is that this is a CE but it sounds like a zero value one, because in resolving an inconsistency you are assumed to have taken the BoQ as correct. That helps you here. It might not in other circumstances.
