JCT: Practical Completion for Sectional Completion Contracts

On a contract that has say two sections, will Practical Completion be deemed to have been “certified” if a a sectional completion notice has been issued for each section ?

In effect, yes.

As practical completion of all of the sections has been certified and there are no remaining works outside of the sections then, strictly speaking, there is no further certificate to issue. All the works are complete and all the consequences of practical completion, such as retention release, liability transfer, insurance obligations of the contractor ending, possession passing to the Employer etc have already occurred.

Just to add to Steven’s comment, it is always worth checking the other contract documents such as the Employer’s Requirements or preliminaries documents as to whether there are specific definitions of Practical Completion such as delivery of all commissioning certificates, as built information, the health and safety file etc.
