If the ER’s / CP’s are vague in specifying the quality of materials and/or workmanship; does the contract imply the requirement to use materials that are in accordance with relevant BS’s (or similar); and that workmanship as a minimum to be in accordance with BS8000
British Standards are not law, they are merely guidelines therefore unless the contract makes explicit a requirement for workmanship and materials to comply with relevant British Standards then it can’t be implied that this is the case. What standards are required will depend on the contents of the Employer’s Requirements and Contractor’s Proposals and interpretation of the relevant JCT clause that requires them to be of a standard appropriate to the works.
