Hi
The works started some time ago based upon a letter of intent and we are about to issue the agreed contract for signing by the contractor (its a JCT Intermediate contract which will be signed as a deed).
Should I insert the current date on the contract or backdate it to reflect the date of the letter of intent (i.e. pre commencement)?
Thanks
@jim823408 unless you wish previous exchanges to (potentially) form part of your contract, you should not backdate it. It would also be a good idea to include an “entire agreement” clause so as to avoid future complications (the date the contract takes effect can still be on commencement or whenever you agree with the other party).
