JCT D&B 2016 as amended.
Completion date is 31st March 2021. Contractor is already way behind programme and has not even been at site for a couple of weeks. It is clear the Contractor (save for some miracle!) will hit the Completion Date but technically speaking is not in breach until 1st April 2021.
Is there anything the Employer can do at this stage notice wise?

Jason. The answer is that you can serve a notice under Section 8.4 of the Contract stating that the Contractor is failing to proceed regularly and diligently with the Works. If this is not corrected within a 14 day period then you can determine the employment of the Contractor and engage another. You need to make sure that any notices are served strictly in accordance with the terms of the Contract. If you need assistance then we can help as need be.
