Can the Employer terminate if an event occurs which stops the Contractor completing the works by the date shown on the Accepted Programme and is forecast to delay Completion by more than 13 weeks?

Only if there are no reasonable means by which the Contractor can recover the delay (such as acceleration, increased resources, altering the programme) and the delay passes the two tests contained in Clause 91.7 which are: neither Party could have prevented the event which caused the delay; and the event had such a remote chance of occurring that an experienced Contractor would have judged it unreasonable to have allowed for it.
