This has long been a source of debate, so the answer would not be clear cut and may well depend on the extent of additional works that are instructed. At one extreme, if the additional work is outside the original definition of the works, then definitely ‘No’, but this would apply before Completion.
A change to a finish because the end client did not like it, then possibly.
However, there are cons mainly from the Client side, namely:
- any re- or on-going mobilisation and preliminary costs would be included as part of the assessment and
- having achieved Completion, no damages could be levied i.e. there is no commercial tool to get the Contractor to do the work promptly.
