The Project Manager has instructed the Contractor to stop or not start any substantial work or all work. Can the Employer terminate?

The Employer may terminate if:

	The instruction was due to a default by the Contractor and

	An instruction allowing the work to restart or start has not been given within thirteen weeks (see Clause 91.6 R18).


If neither Party was culpable for the instruction to stop work, then either Party may terminate (R20 Clause 91.6).
