The completion of the project I’m on is 3 months away and the client wants temporary hoardings and fences removed from around two finished ground floor units, making them available to tenants. However, the contract does not provide for phased completion, no option X5. Can this be accommodated contractually and if so the financial implications?
Yes, the Client can do this via “take over”, it’s covered in CL.35. “Take over” before Completion is a Compensation Event - cl.60.1.(15). You would need to assess the cost & time impact of an instruction for “take over” and put this in the CE quotation. The PM needs to certify the area taken over by the Client within one week on “take over”.
