If the Project Manager has issued a termination certificate for an Option A contract, what is the procedure for this termination and what is the role of the Employer, the Project Manager and the Contractor?
There is a X1 clause but I am not sure if this is important as the Contractor has only been on site for 2 weeks and only carried out some minor setup works.
Section 9 contains the termination provisions. The procedure and the amount due depend on the reason for termination with reasons stated in clause 91, procedures to be followed in 92 and amount due 93. The table in clause 90.2 defines what procedure is followed and amount due paid depending on the reason and who is the terminating Party.
I don’t think X1 is relevant to the situation, but cannot say for certain with details as to why it might be.
