Does the Contractor have the right to notify a compensation event under Clause 61.1(19) at all times or only following an instruction from the Project Manager under Clause 19.1?
in accordance with clause 61.3 the Contractor is required to notify of an event which has happened or which it expects will happen if it considers the matter to be a compensation and the PM has not notified. therefore yes the Contractor does have the right if it believes the event has/will happen. an instruction under 19.1 would normally follow acceptance of a CE under 61.1(19) not the other way round.
