How should the Contractors Design from an earlier contract be incorporated into subsequent phases of work? i.e. Concept Design undertaken used as a basis for a subsequent Detailed design Phase (separate Contracts).
The answer is very simply referenced as part of the Works Information.
However, there are two Works Informations : the Employer’s and the Contractor’s. If referenced as the Contractor’s (from Contract Data part 2), then the Contractor takes the risk of any ambiguities or inconsistencies both within those documents and with any Employer’s Works Information. As they developed it, in these circumstances, that seems fair.
