The contract states that the Contractor is required to make an application, but what happens if they do not? is the employer still obliged to value the works at the date of the valuation? It was my understanding that they had to still value the Works (although this is on the basis of the subcontract)
Clause 4.7 sets the due date for each payment as being dependent upon the issue of an application by the Contractor. Accordingly, the payment process does not start until the Contractor makes an application.
This is different to the JCT Standard Building Contract which requires the CA/Architect to assess and certify payment irrespective of whether the Contractor makes an application.
