JCT: Applied for EOT and no response

JCT CONSTRUCTION MANAGEMENT TRADE CONTRACT 2011

Having applied for an EOT but received no formal response from the Main Contractor is a Subcontractor required to carry out Instructed Variations after the original Practical Completion date of the Subcontract Works. Delay has been caused by the Main Contractors failure to provide access to the area of outstanding Contractual Scope of Subcontract Works? What happens next?

The standard Works Contract allows you a right of reasonable objection to Variations. if you read clause 3.4 in the Works Contract you will be able to see how Variations are instructed. I would suggest that the best way forward is to say that you are unable to carry out further Variations until such time as the EOT is dealt with as you cannot be sure that you can organise your resources properly until such time as you know where you stand with the EOT.
