The Scenario is as follows:
The WI required us (the Contractor) to provide a series of resources to support a live environment during certain activities and to stand-down activities based on a set of parameters within the live environment.
The Employer instructed:
a) an increase to the number of resources required to support the live environment and also
b) changed the parameters when activities should be stood down.
The impact of the instruction is as follows:
a) an increased cost per day when the support resources were required and increased number of days these resources were required.
b) a delayed Completion Date due to increased stand-down days.
Additionally, the Contractor’s planned Completion was already after the Completion Date and as a consequence of the instruction went back further.
The Interpretation is as follows:
The Contractor can increase the prices by the additional forecast Defined Cost from the point of assessment until the planned Completion (despite the planned Completion having delays caused by the Contractor unrelated to this instruction). Comments on this interpretation welcome thank you.
