We are the PM working on an NEC 3 ECC option E contract. Under people cost within the SOCC payment for vehicles is allowed as is travel. The Contractor is applying for tolls and fines incurred as part of their AFP. Is this able to be paid? I don’t see a reason for it to be disallowed under the contract but it just seems unfair that the Contractor can rack up such fines and expect the Employer to pay just because they are not willing to use a different route (which is able to be used). Should this be deemed as part of the fee?

Tolls - I’d probably agree to that. OK, its strictly discretionary, you can avoid it, but I assume they use the tolled route to save time. You are probably getting value for it.
Fines - There is no way you should be paying fines. It seems they are for the tolled route you mention; but I’m amazed that a Contractor is even asking for that. They have to pay the toll! Just go to the preamble in SoCC - fines are not incurred to provide the works.
