Can the Contractor be penalised if a target for a KPI is not achieved?
No. KPIs are intended to encourage rather than coerce the Contractor to meet objectives. Therefore, the Contractor will be paid a bonus if the KPI is achieved but should not be penalised if it is not achieved.
