Can an NEC3 contracts include electronic copies of drawings and other documents?

Can an NEC contracts include electronic copies of drawings and other documents? We have a high value contract which has a several hundred contract drawings and specification schedules which would be voluminous to include within the contract. We’d like to include a CD instead with a schedule of documents included.

Yes, absolutely no problem. Just reference from Contract Data Part 1 where it says "The Works Information is in … … " the CD and match the labeling on the CD to that of the reference.

Likewise for Site Information.

In principle yes there is no reason why the contract can’t include a mixture of hard/paper copy and electronic media like CD roms or be formed by electronic correspondences entirely. The contract can even by executed via an electronic media (subject to copyright permission).

However the main stumbling block with doing this is making sure its evidenced correctly (both in terms of fraud and innocent mistakes). I’d sugest if you wish to include a CD rom that all the documents and their respective references and revision numbers are clearly marked in a paper schedule to avoid confusion.
