We are managing an NEC3 construction contract and the local authority are imposing conditions that restrict how the works must be delivered eg, working hours, noise levels etc. The works information contains general requirements for the Contractor to agree and comply with conditions imposed by the LA, however no specific limits or times etc.
Is this an additional constraint to how the works must be delivered , a change to the works information under 60.1(5) or must be instructed by the PM under 60.1(1)?
