Are there any cases in which the need for a contract to be treated as evidence in writing under the Construction Act do not apply?

When the adjudication provisions are based on a contractual agreement, and / or when a contract is entered into after 1st October, 2011. (See Treasure & Son Ltd v Dawes [2007] EWHC 2420 (TCC).)
