Hi

In the event of subcontractor delay can the main contractor deduct/charge for the damages stated in contract data part 1 without having to demonstrate actual losses?

This is correct yes, however before doing so the Contractor should ensure the reason for the delay is not related to CEs which could entitle the Subcontractor to an extension of time.
