With regard to procurement legislation, when might a court impose the ‘remedy of ineffectiveness’?

In order for this to apply, one of the following two criteria must be satisfied:

	     There must have been a failure to advertise the contract in OJEU;

	     Some breach of procurement rules which prevented a tenderer winning a contract, along with an incorrect application of the standstill period, must have taken place.
