With regard to procurement legislation, is it obligatory for a purchaser to advise a supplier of the Most Economically Advantageous Tender?

A new EC directive (2004/18/EC) has been passed with relation to this issue which calls for more transparency from providers. In short, the purchaser is legally obliged to indicate before suppliers submit tenders the criteria that will be used in making an assessment of the most economically advantageous tender. This can be disclosed via either contract notice or in the contract documentation.
