The Employer has terminated because the Contractor has appointed a Subcontractor for substantial work before the Project Manager has accepted the Subcontractor (R13). What is the amount due?

The amount due on termination includes:

	An amount due assessed as for normal payments,

	The Defined Cost for Plant and Materials

	Other Defined Cost reasonably incurred in expectation of completing the whole of the work,

	Any amounts retained by the Employer and

	A deduction of any un-repaid balance of an advance payment (Clause 93.1 A1)


As well as:


	A deduction of the forecast of the additional cost to the Employer of completing the whole of the works (Clause 93.2 A3).
