We have agreed several events as CE’s and the QS has agreed the change to completion date element. However the costs for PM and QS time as prelim items within our quote have been rejected. The reason being office management costs are deemed included within our fee percentage. This is an overseas project so the PM and QS are based in the UK but our view is that when a change to completion date is applicable due to a CE, the additional time for this management resource is recoverable for the additional period they are involved in the project
Under NEC3,the costs of preparing a quotation are not recoverable, and deemed part of the Direct Fee Percentage. However, it would appear that what you are talking about is the cost of the PM/QS’s elongated involvement in the project as a result of an EOT. In my view, this is recoverable.
Under NEC4, the bar to recovering costs for providing a quotation has been removed, so both this element, and the elongation are recoverable.
However, the remoteness to the actual project location may prove an obstacle to your recovery, unless the definition of what constitutes the working area for these staff has been adjusted. If the staff are outside the working area, without some form of wording to clarify, they may be deemed an off-site overhead.
To build on Shaun Farrellys point this is purely about Working Area.
If the People that have been excluded are not within the defined Working Area then they are not deemed as Defined Cost and are deemed as being included in the Fee.
You may need to get approval to extend your Working Areas to the individuals working locations in the UK and if accepted i agree they should be able to be recovered as part of the team working on the project for the extended period due to the change in the completion date.
