On termination, can the Employer use Equipment to which the Contractor has title?

Yes - if P3 applies to the termination (i.e. the Employer has terminated for reasons R1-R15 or R18 see termination table Clause 90.2) he can use it to complete the works. The Contractor removes this Equipment from the Site when notified by the Project Manager that the Employer no longer requires it.
