NEC4 Option C, Best approach to seek compensation following a breach by a sub-contractor

We are the sub-contractor on a highways project and our supplier’s delivery tanker’s boiler cut out, leaving us with material which couldn’t be poured. This meant the excavations had to be temporarily filled and the remaining works reprogrammed. As a result we are incurring the costs of the additional shift, traffic management etc.

What is my best course of action, can I raise a compensation event for this or is it something I should seek reimbursement for from our supplier? would it be possible to contra-charge the supplier?

What you have described is a matter between yourselves and your supplier. What recourse you have will be dependent upon the contract (and provisions) you have with the supplier.
