When Contractor claim L&E related to Extension of Time, they could claim the additional costs associated with EOT while still in Contract period. However, can they claim the increasing costs which use BCIS index to calculate inflation based on total Contract Sum?
Can they use formula (e.g. Emden formula) to claim OH&P on the above increasing costs?
The contract is JCT Standard Building with Contractor’s Design Portion.
