Ive spotted an issue in the Works Information provided by the Contractor for its design. This design includes a manual sprinkler system for the pitch, to be provided by a Sub Contractor . However, the Works Information provided by the Employer states that an automatic sprinkler system should be provided.
What process should the Project Manager instigate in order to resolve this? The Employer wants the automatic system – who should pay for this? How does this scenario affect the Prices and Defined Cost?
The Project Manager could issue an instruction under clause 14.3 to clarify that the automatic sprinkler is required. The instruction would not be a compensation event because of the second bullet point in clause 60.1(1) ie it was a change to comply with the Works Information provided by the Employer.
Since the matter would not be a compensation event the Prices would not be changed.
The cost of providing the automatic system would be Defined Cost included in the Price for Work Done to Date and therefore any cost difference would be shared under the Contractor’s share assessment.
