I think your questions is: “Is a corrupt act a Compensation Event?”. In short, yes it is. A corrupt act carried out by a Contractor or supplier would give rise to a contract termination under Cl.91.8. If the Client carried out a corrupt act there are various ways to Compensate the Contractor, it could be a material breach of contract and a CE under Cl.60.1.(18). It could also be recovered as an event which was a Client liability (Cl.60.1.14) and costs recovered under Cl.80.1 (first bullet point: second part). It would also fall down under Cl.10.1 as neither party are “acting in the spirit of mutual trust”.
