Under the current legislation there is no obligation for the utilities to make any announcement should a contract not be awarded after a call for competition. However, the recent amendment to the legislation, 98/04/EC, does require the utilities in certain sectors to keep OJ and bidders informed when requested when a contract is not to be awarded.
