Under the existing legislation, there is no reason that utilities cannot stipulate that products purchased to fulfill a contract meet a certainly environmentally-friendly specification. However, it is legally tricky to dictate that businesses must follow a certain environmentally-related approach with regard to the way that their business is carried out. Criteria used in pre-qualification must be of relevance to the specific procurement involved, and in line with the existing procurement legislation.
