What remedy does the Employer have if the Contractor fails to complete the works by the Completion Date if Option X7 is not included?

Under English law and some other legal systems, if Option X7 is not included, delay damages are ‘at large’ and the remedy open to the Employer if the Contractor fails to complete the works by the Completion Date is to bring an action for damages for the Contractor’s breach of contract. In this event, evidence of the actual damages suffered by the Employer is required.
